By his will he devised (inter alia) his lands at Ballyarton to Henry and John (subject to the right of his widow and daughter, Mary Jane, to a room each with firing and feeding and grass for a couple of cows) and his stock crop implements etc. in equal shares to his four sons Henry, John, Dick and Patrick. The implements, at date of death were worth £14:5:0. The stock and crop, of course, have since been disposed of. John died a bachelor, intestate, on 21st February, 1934. His estate consists of half the value of the farm at Ballyarton, of which he and Henry were registered owners, his own stock, worth £41:0:0, household furniture, worth £1:0:0 and one fourth of the implements, £1:11:3. He had no cash either in the bank or house. He was liable for all his own debts and one half of the debts due in connection with the farm at Ballyarton. A summary of his estate is set out below. His personal estate is insufficient to discharge all liabilities. The lands pass to Henry as survivor of the joint tenant. Henry Grant died on the 16th March 1934. His estate consists of the full value of the lands at Ballyarton passing to him as surviving registered owner, one fourth of the implements, £3:11:3, under his fathers Will, his own stock etc. value of £59. He was liable for his own debts and one half of the farming debts. He had no cash either in house or bank. By his Will he devised and bequeathed all his estate to his mother, Jane Grant, and his sister Mary Jane Grant. A summary showing his nett estate is set out below. Jane Grant died on the 23rd June 1934. She was therefore, possessed of one half of the farm at Ballyarton under the will of Henry and one half of his nett personal estate. Jane Grant was in the year 1928 paid £100 the amount of a legacy under her husbands Will. She placed same immediately in the joint name of herself and her daughter Mary Jane in the National Bank on deposit receipt. Miss Mary Jane Grant claims that same was put in the joint names by her mother for the absolute benefit of said Mary Jane, and being more than three years before the death of Jane Grant, same has not been accounted for. Is any relief due against the Estate Duty under the Finance Act for "quick succession"? Is there any duty payable on the cesser of the life interest of Jane Grant in part of the dwelling house on the lands?
